1. Agreement to Terms
By accessing or using the MyAirplaneFare.com website and its services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Maasco Tech LLC, doing business as MyAirplaneFare.com. If you do not agree to these Terms, you must not use our Service.
2. Our Role as a Travel Agency
Important: We are an Independent Travel Agency
MyAirplaneFare.com acts as a booking agent. We do not own, operate, or control the airlines or any other travel suppliers. When you book a flight, you are entering into a contract directly with the airline. Our role is to facilitate your booking. The airline's terms and conditions, fare rules, and policies apply to your booking in addition to our Terms.
3. Pricing, Fees, and Payment
a. Total Price: The total price displayed for a flight booking is composed of the airline's base fare, applicable taxes and carrier fees, and our non-refundable service fee.
b. Our Service Fee: For the value we provide in searching, booking, and managing your travel, we charge a service fee. This fee is essential for us to operate and provide customer support.
- Variable Fee Structure: Our service fee is dynamic and varies based on several factors, including the complexity of the trip, the type of fare, and specific travel needs. The service fee can range from a minimum of $25.00 USD to a maximum of $200.00 USD per person. This fee is disclosed as part of the total price before you complete your purchase.
- Non-Refundable: Our service fee is charged at the time of booking and is non-refundable under all circumstances, even if the airline cancels the flight or you are eligible for a refund on the ticket portion of your purchase.
c. Payment: By providing your payment information, you authorize MyAirplaneFare.com and its third-party payment processors to charge the total amount of your booking. You agree to have sufficient funds available for the transaction. In some cases, you may see separate charges on your statement: one from the airline and one from us for our service fee.
4. Bookings, Changes, and Cancellations
a. Booking Confirmation: After you complete your booking, we will send you a confirmation email. It is your responsibility to review all details for accuracy and inform us immediately of any discrepancies.
b. Airline Rules: All flight tickets are subject to the rules and restrictions of the airline, which can be found in the "fare rules" during the booking process. These rules govern changes, cancellations, and refunds. Many fares, especially discounted ones, are non-refundable and non-changeable.
c. Changes & Cancellations by You: If you need to change or cancel your booking, you must contact us. If the airline's fare rules permit a change or cancellation, you will be responsible for:
- Any penalty fees charged by the airline.
- Any difference in the new fare price.
- A separate and additional post-booking processing fee charged by MyAirplaneFare.com for our service in facilitating the change or cancellation on your behalf. This fee is separate from our initial booking service fee and any fees charged by the airline.
d. Schedule Changes & Cancellations by Airlines: Airlines may change schedules or cancel flights. We will attempt to notify you of significant changes but are not responsible for these actions. Your recourse is with the airline directly.
5. Baggage Policy
Fares displayed on our site include the airline's standard baggage allowance for the specific fare class. Any additional baggage (checked bags, oversized items, etc.) must be arranged and paid for directly with the airline. We do not handle extra baggage services.
6. User Responsibilities
By using our Service, you agree that:
- You are at least 18 years of age.
- All information you provide is true, accurate, and complete.
- You are solely responsible for ensuring you have all necessary travel documents, including valid passports, visas, and any required health documentation.
- You will use the Service for legitimate booking purposes only.
7. Limitation of Liability
As an intermediary, MyAirplaneFare.com is not liable for any act, error, omission, injury, loss, accident, delay, or any other issue arising from the services provided by the airlines or other third-party suppliers. Our liability for any claim arising from our Service is limited to the amount of the service fee you paid to us.
8. Indemnification
You agree to indemnify and hold harmless Maasco Tech LLC, its brand MyAirplaneFare.com, and its directors, employees, and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs or expenses of any kind or nature, including but not limited to reasonable legal and accounting fees, brought by third parties as a result of your breach of these Terms, your violation of any law or the rights of a third party, or your use of our Service.
9. Dispute Resolution by Binding Arbitration
Please read this section carefully as it affects your rights.
a. Informal Resolution: We are committed to customer satisfaction. If you have an issue or dispute, we encourage you to first contact our customer service team to try and resolve your problem directly with us.
b. Governing Law: Any dispute arising from these Terms shall be governed by the laws of the State of Minnesota, USA, without regard to its conflict of law provisions.
c. Agreement to Arbitrate: You agree that any and all disputes or claims that have arisen or may arise between you and Maasco Tech LLC (dba MyAirplaneFare.com) shall be resolved exclusively through final and binding arbitration, rather than in court. The arbitration will be conducted in Hennepin County, Minnesota, under the rules of the American Arbitration Association.
d. Prohibition of Class and Representative Actions: You and Maasco Tech LLC agree that each of us may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding.
10. Modification of Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
